Who sets it
The Minimum Wage Ordinance sets the system. The Chief Executive in Council decides the rate after a review by the Minimum Wage Commission.
How it changes
The rate is reviewed regularly and is announced in advance of the date it takes effect, which has been 1 May in recent years.
Who is covered, and who is treated differently
- Live-in domestic workers are outside the Ordinance, and so are student interns and work-experience students.
- Employers must keep records of hours for lower-paid employees.
What to watch for
- The rate is per hour. Check the Labour Department's current notice.
Understand the legal system first
Hong Kong belongs to the Common law family. How pay is regulated depends on how the legal system makes and applies labour law.
