Who owns what in a marriage? The US states compared

Nine states, mostly in the West and the South, follow the community property system inherited from Spanish and French law: what either spouse earns or acquires during the marriage belongs to both, and is generally split equally on divorce. The other states divide marital property 'equitably': fairly, in a way the judge decides, which is often but not always equal. Alaska lets couples choose community property by agreement.

In a divorce, does the state treat earnings and property acquired during the marriage as shared 50-50 (community property), or divide them by what is fair (equitable distribution)?

Read this before you quote the map

  • Even in community property states, property one spouse owned before the marriage, or received as a gift or inheritance, usually remains separate.
  • Equitable distribution states vary a good deal in how far they push towards an equal split. The label tells you the starting point, not the result.
  • Several states let couples set up community property trusts. These are not shown as community property states.
