Module 5

Rights, administrative law and EU law: fundamental rights, foreign nationals, administrative procedure, administrative courts and the relationship with European law

The **Constitution of 1978** places **human dignity** and **inviolable rights** at the foundation of the political order (Article 10). It lists **fundamental rights and public freedoms** in Title I, and gives the strongest protection to some of them through **special judicial procedures** and the **amparo** complaint. **Foreign nationals** enjoy the **rights that belong to the person**, but **not political rights**, and their stay is governed by the **immigration law** (Module 8). Public authorities act through **administrative procedures** that give people rights and, when a decision is unlawful, the **administrative courts** can **annul** it. **EU law** applies beside the Constitution. **Time limits are short** and change by statute, so they are marked for checking.
