Module 4

Rights, citizenship and administrative law: fundamental rights and duties, foreign nationals, administrative procedure, administrative justice and data protection

The Italian Constitution protects **inviolable rights** and also imposes **duties of solidarity**: to pay taxes, to defend the country and to contribute to society. It protects **personal liberty**, **expression**, **religion**, **family**, **health**, **education**, **work** and **property**, and it speaks of the **social function** of private initiative. **Foreign nationals** enjoy the **fundamental rights of the person** but not **political rights**, and their stay is governed by the **immigration code** (Module 8). Public authorities act through **administrative procedures** that give people rights and, when a decision is unlawful, the **administrative courts** can **annul** it. **Data protection** follows **EU law**. Time limits are short and **change by statute**, so they are marked for checking.
