Module 3
Contract law: formation, terms, vitiating factors, breach and remedies
Contract law is judge-made in origin, built up case by case from the nineteenth century, with statutes layered over it for consumers, exclusion clauses and third parties. Its core idea is that the law will enforce a promise when it has been made as part of a bargain. This module follows the life of a contract: how one is formed, what it contains, what can go wrong at the start, how it can end, and what the law gives the party who is let down. Throughout, the court looks at what the parties objectively said and did, not at what either privately intended.
