Module 5
Private law: persons, legal transactions, breach, tort, property, family, succession, civil procedure and dispute resolution
The BGB is built as a system, and learning it means learning how its parts fit together. The **General Part** states rules that apply to everything: legal capacity, declarations of intent, the formation, validity and avoidance of legal transactions. The **Law of Obligations** states what the parties owe to each other, from contract, tort and unjust enrichment. The **Law of Property** governs who owns what, and the **Family** and **Succession** books govern relationships and inheritance. Alongside them, the **Code of Civil Procedure** and the Mediation Act govern how disputes are resolved. This module goes through the Code in that order. A German lawyer solves a problem by asking, step by step, **who wants what from whom, on what basis** (*Anspruchsgrundlage*), and then testing each requirement.
This course explains the law of Germany, not US law. Rules that look the same elsewhere may be different.
