The Law To Know

Module 6

Civil law, property, family and civil procedure: the Contract Act 1872 and remedies, ownership and land records, registration and mutation, Muslim family law, inheritance and wills, and the Code of Civil Procedure

Private law is where most people and most businesses meet Pakistani law: a contract that is signed or broken, a plot or house that is bought, a marriage that begins or ends and an estate that must be divided. The law is mostly statute, and much of it is old and recognisable: the Contract Act 1872, the Transfer of Property Act 1882, the Registration Act 1908, the Code of Civil Procedure 1908; but it sits beside provincial land-revenue law, Muslim personal law and local practice, which together decide what actually happens. Three habits help every reader: distinguish a contract from its performance, distinguish title from the record and from possession and ask which personal law applies to the family. A foreigner who rents a flat, buys land or marries a Pakistani citizen meets all three.

This course was written on 6 November 2026. To the best of our knowledge, it describes the law of Pakistan as it stood on that date. Laws change, and we may have missed or misunderstood something. If you notice a change, or have other information, please do not hesitate to contact us: we will review it and update the course. We do not claim to be the final source of the law.
