Capstone: Anna Lindqvist sells across the Union

Anna Lindqvist is an invented sole trader in member state A. She makes and sells handmade wooden toys through her own website. Her toys are lawfully made and sold in A and comply with the Union’s toy safety rules. In member state B, a national rule says that every toy sold there must carry a label in B’s language and a safety mark issued by B’s own testing body; the body is slow and charges a fee. Anna’s orders from B have been stopped at the border. Separately, a customer in member state C says that a toy was defective and wants a refund; Anna’s terms say that A’s law and A’s courts govern every dispute. Another customer has written to ask her to delete all of the personal data she holds about them. Finally, her part-time assistant says that a Union directive gives them a right to written information about their working conditions, which the state has not yet put into national law, and that they can enforce it against her. You are asked to advise. Use the four questions from Module 3 and the three tools. The states are left abstract and the facts are invented, so state your assumptions as you go.
